1. Acceptance of Terms

By accessing or using the RecycleForGood platform ("Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Platform.

These Terms constitute a legally binding agreement between you and RecycleForGood (ABN 47 685 766 001) ("we," "our," or "us").

2. Description of Service

RecycleForGood is a platform that connects households with local collectors to facilitate the collection and recycling of eligible containers (cans and bottles) under Australia's container deposit schemes.

We are a technology platform only. We do not:

  • Employ collectors or control their work
  • Guarantee the availability, quality, or safety of collection services
  • Process or handle recyclable materials ourselves
  • Operate container deposit scheme collection points

3. Eligibility

To use the Platform, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Reside in Australia
  • Provide accurate and complete registration information
  • Comply with all applicable laws and regulations

4. User Accounts

4.1 Account Creation

You must create an account to use certain features of the Platform. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4.2 Account Types

Household Accounts: For users requesting pickup services

Collector Accounts: For users providing collection services

You may only create one account per person. Creating multiple accounts may result in suspension or termination.

4.3 Verification

We may require identity verification for certain account features. You agree to provide requested verification documents and understand that failure to verify may limit your access to Platform features.

5. User Conduct and Responsibilities

5.1 Prohibited Conduct

You agree NOT to:

  • Violate any laws, regulations, or third-party rights
  • Provide false, misleading, or fraudulent information
  • Impersonate any person or entity
  • Harass, threaten, or abuse other users
  • Collect or store personal data of other users without consent
  • Use the Platform for any illegal or unauthorized purpose
  • Interfere with or disrupt the Platform's operation
  • Attempt to gain unauthorized access to the Platform
  • Use automated systems (bots, scrapers) without permission
  • Post or transmit harmful content (viruses, malware, etc.)

5.2 Household Responsibilities

If you are a household user, you agree to:

  • Only offer eligible containers (cans and bottles covered by container deposit schemes)
  • Ensure containers are reasonably clean and safe to handle
  • Provide accurate pickup location and instructions
  • Be available or make arrangements for contactless pickup
  • Not include hazardous, sharp, or prohibited items
  • Treat collectors with respect and professionalism

5.3 Collector Responsibilities

If you are a collector, you agree to:

  • Only collect from scheduled, confirmed pickups (no bin diving or unauthorized collection)
  • Arrive at agreed times or communicate delays promptly
  • Handle containers safely and respectfully
  • Leave pickup areas clean and tidy
  • Comply with all safety guidelines and local regulations
  • Treat households with respect and professionalism
  • Accurately report collection quantities
  • Return containers to authorized collection points

6. Fees and Payments

6.1 Household Subscription

Household users pay a subscription fee of $7.00 AUD per year (approximately $0.13 per week). This fee covers platform access and unlimited pickup requests.

6.2 Collector Payments

Collectors receive a share of the container deposit refund as agreed upon for each pickup. Payment terms and processing are outlined in the Platform.

6.3 Payment Processing

Payments are processed through third-party payment processors. You agree to comply with their terms and conditions. We are not responsible for payment processor errors or delays.

6.4 Refunds

Subscription fees are generally non-refundable except as required by Australian Consumer Law. Refund requests should be directed to [email protected]

6.5 Fee Changes

We reserve the right to change fees with 30 days' notice. Continued use of the Platform after fee changes constitutes acceptance.

7. Safety and Liability

7.1 Independent Contractors

Collectors are independent contractors, not employees or agents of RecycleForGood. We do not control, direct, or supervise collection activities.

7.2 User Interactions

You are solely responsible for your interactions with other users. We do not guarantee the conduct, identity, or safety of any user.

7.3 Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability is limited to the fees you paid in the 12 months prior to the claim
  • We are not responsible for loss, damage, or injury arising from user interactions
  • We do not guarantee uninterrupted, secure, or error-free service

7.4 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law or other applicable laws that cannot be excluded.

7.5 Insurance

We recommend that collectors maintain appropriate insurance coverage. We do not provide insurance for collectors or their activities.

8. Intellectual Property

The Platform and its content (text, graphics, logos, software, etc.) are owned by RecycleForGood and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute Platform content without permission
  • Use our trademarks, logos, or branding without authorization
  • Reverse engineer or attempt to extract source code
  • Create derivative works based on the Platform

You retain ownership of content you submit but grant us a license to use it for Platform operation and improvement.

9. Ratings and Reviews

Users may rate and review each other. You agree that:

  • Ratings and reviews must be honest and based on actual experiences
  • You will not post false, defamatory, or abusive content
  • We may remove ratings or reviews that violate these Terms
  • Ratings and reviews are opinions and we are not responsible for their accuracy

10. Privacy and Data Protection

Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to our privacy practices as described in the Privacy Policy.

11. Suspension and Termination

11.1 Our Rights

We may suspend or terminate your account at any time if you:

  • Violate these Terms or our policies
  • Engage in fraudulent or illegal activity
  • Pose a safety risk to other users
  • Receive consistently poor ratings or reports
  • Fail to pay required fees

11.2 Your Rights

You may close your account at any time by contacting us. Closing your account does not entitle you to a refund of subscription fees.

11.3 Effect of Termination

Upon termination:

  • Your access to the Platform will be revoked
  • Outstanding payments remain due
  • Certain provisions of these Terms survive termination (liability, indemnification, etc.)

12. Indemnification

You agree to indemnify and hold harmless RecycleForGood, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • Your interactions with other users

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.

13.2 Disputes Between Users

Disputes between users should be resolved directly between the parties. We may provide information to assist resolution but are not obligated to mediate or resolve user disputes.

13.3 Disputes with RecycleForGood

Before initiating legal action, you agree to contact us at [email protected] to attempt informal resolution.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms on the Platform
  • Updating the "Effective Date" at the top
  • Sending email notification (for significant changes)

Your continued use after changes become effective constitutes acceptance of the updated Terms.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced, constitute the entire agreement between you and RecycleForGood.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

15.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.

15.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, strikes, government actions, etc.).
